Welcome to Rival.Music®. By accessing or using our services, website, and affiliated platforms, you agree to be bound by the terms and conditions set forth below. These terms serve as a legal agreement between you ("the User") and Rival.Music®, governing your access to and use of our services.
Language of the Agreement
This Agreement is drafted and executed in the English language.
Should any translations of this document be prepared for convenience or any other purpose, the provisions of the English version shall prevail.
It is your responsibility to ensure that you fully understand the terms of this Agreement, and we encourage seeking the advice of a legal professional if necessary.
Definitions
"You" / "The User" / "Client" refers to any individual or entity that accesses or uses Rival.Music®'s services, website, or affiliated platforms, including Rival.Music Studios and The Practice Room.
"Rival.Music®" / "We" / "Us" refers to the Rival.Music® brand, encompassing all its services, digital platforms, and physical locations.
"Rival.Music Studios" refers to our spaces dedicated to music production, mixing, mastering, podcast production service, music production workshop and other audio engineering services.
"The Practice Room" refers to our designated space for rehearsals, collaborative music creation, and other activities.
"Services" encompasses all products, services, and content provided by Rival.Music®.
Eligibility
Age Restrictions:
Users under the age of 16 must have consent from their parents or legal guardians, provided in writing to info@rivalmusic.co.uk, to use Rival.Music® services.
Parents or guardians wishing to review, amend, or stop the collection of their child's data can contact us at info@rivalmusic.co.uk for assistance.
Purpose of the Agreement
This Agreement outlines the terms under which Rival.Music® offers you access to our services. Our goal is to foster a creative, respectful, and law-abiding community, protecting both you, the User, and the integrity of Rival.Music®.
Terms and Conditions Updates
Rival.Music® reserves the right to update, change, or replace any part of these Terms and Conditions.
Significant changes will be communicated via email to ensure users are informed promptly.
It remains your responsibility to periodically check this page for updates.
Your continued use of or access to the website or the Service following the posting of any changes constitutes acceptance of those changes.

Payment
Payment Requirements:
To confirm bookings for both studio hire/services and practice room hire, clients are required to make full payment using one of the following methods:
Credit/Debit Card: Secure online payments can be made via credit or debit card through our official booking platform.
Cash or Bank Transfer: For those preferring cash or bank transfer, the full amount must be received by Rival.Music® Studios at least 48 hours before the scheduled session time. Booking confirmation is subject to payment verification.
Payment Confirmation:
Upon successful payment, a confirmation email with transaction details will be sent to the provided email address. This email serves as proof of payment and should be retained for your records.
Currency and Payments:
All transactions are conducted in the currency stated on our Website, with clients responsible for any conversion fees.
Pricing for each service is explicitly stated under the respective product or service description on our Website. Payment is required in full before any service commencement or product delivery.
Cancellations and Refunds
Cancellation by the Client:
Cancellations with a minimum of 48 hours' notice before the scheduled start time are eligible for a full refund.
Cancellations within 48 hours of the booking will incur a 50% fee.
Rescheduling within this 48-hour period is subject to studio availability.
Cancellation by Rival.Music®:
Rival.Music® reserves the right to cancel any booking due to unforeseen circumstances or events beyond control, such as equipment failure or facility maintenance.
Efforts will be made to reschedule the booking at a convenient time for the Client.
If rescheduling is not possible, a full refund of any fees paid will be provided.
In the event of a breach of these Terms and Conditions by the Client, Rival.Music® may cancel the booking without a refund.
These policies apply to bookings made directly through Rival.Music®. Third-party booking platforms may have their own cancellation policies.
Services
Services Overview
Rival.Music® Studios
Specialised studio services including audio recording, mixing and mastering, and audio editing, offered on an hourly hire basis in accordance with the terms of this agreement.
The Practice Room
A dedicated space within Rival.Music® Studios available for hire on an hourly basis, designed for instrumental instruction, vocal coaching, and songwriting or rehearsal sessions for artists, musicians, or songwriters.
Mixing & Mastering Services
Provides comprehensive mixing and mastering services for projects ranging from 1-50 stems, tailored to meet the unique needs of each project for the highest quality audio output.
Clients receive tracks as mastered stems and a final stereo master, with options for projects requiring solely stereo mastering.
Vocal Mix, Comping & Tuning
Offers up to 22 vocal stems with complete comping, mixing, and tuning, ensuring polished, professional-quality vocal tracks.
Additional vocal stems beyond the limit are subject to discussion and agreement on additional charges.
Podcast Production Service
An all-inclusive package for the production of a 1-hour podcast episode, including recording, editing, mixing, mastering, and custom sound design.
Includes a 2-hour studio session for setup and preparation, ensuring an efficient production process.
Music Production Workshop
A 4-hour workshop aimed at beginners, offering an immersive introduction to music production, including how to navigate Logic Pro X, create beats, and understand song structure and the basics of mixing and mastering.
Attendees retain full ownership of their creations, including all stems and the stereo mix.
Audio for Film & Media
Customised audio solutions for film, television, games, and other media, tailored to the unique needs of each project.
A wide range of audio services offered, including audio mixing for film, voice acting, and audio production for social media platforms, inviting clients to discuss specific audio needs for tailored service quotes and project management.
Delivery of Services
Services at Rival.Music Studios or The Practice Room are rendered strictly within the reserved time slot upon full payment confirmation.
Scheduled services commence and conclude at the booking-specified times, without exception.
Clients are responsible for punctual arrival and readiness to maximise scheduled time usage.
Failure to arrive on time does not entitle the Client to refunds or additional time.
By booking and entering the facility, the Client agrees to these conditions.

Online Services:
Mixing & Mastering.
Vocal Mix, Comping & Tuning.
These services are exclusively online, eliminating the need for any in-person studio visits. Designed to bring Rival.Music®'s professional audio engineering directly to you, this setup facilitates convenient and flexible collaboration from anywhere around the globe.
Service Modification
Request Process: Clients seeking to modify their booking, including cancellations or rescheduling, must contact Rival.Music at least 48 hours before their scheduled session to avoid any fees.
Client Material Submission
Submission Guidelines: Clients are encouraged to submit their stems or mixes in a zip folder, with each track clearly labeled and starting/ending at the same point for synchronisation. For optimal quality, tracks should be submitted with a minimum resolution of 24-bit and a 44.1 kHz sample rate.

Quality Assurance and Control
Rival.Music® commits to the highest standards in audio services and facility management.
Our quality assurance and control procedures include regular equipment maintenance, scheduled facility inspections, and ongoing staff training in industry best practices.
We respond promptly to any issues or concerns, ensuring corrective actions are taken to maintain our service quality.
Securing a booking with Rival.Music® signifies the Client's trust in our dedication to providing unparalleled service through rigorous quality assurance mechanisms.
Client's Recordings and Data Security
Retention: Rival.Music® Studios will retain client recordings for up to 2 weeks following the session. After this period, to manage storage and uphold privacy, the files will be systematically deleted.
Recommendation for Backup: Clients are strongly advised to utilise reliable backup methods, such as USB drives, external hard drives, or cloud storage solutions, to safeguard their recordings. These practices ensure the long-term preservation and accessibility of your valuable recordings beyond our retention window.
Loss of Data: Rival.Music® disclaims responsibility for any loss of data, including recorded materials, project files, or any other digital or physical data. The proactive use of recommended backup methods is crucial for data security.
Intellectual Property Rights
Client's Ownership: Clients maintain full ownership rights over all recorded materials produced during sessions at Rival.Music® Studios, encompassing music recordings, song lyrics, and other created content.
License Granted to Rival.Music®: Clients grant Rival.Music® a non-exclusive license to use the recorded materials solely for delivering agreed-upon services, such as mixing and mastering.
Rival.Music® may request clearance to use client materials for promotional purposes, subject to approval by the client.
Confidentiality
Rival.Music® commits to the confidentiality of all client-provided materials and data, ensuring privacy and security in handling creative works and personal information.
Access and Disclosure: Access to client materials is limited to authorised personnel, necessary for service fulfilment.
Use of Client Data: Use of client data is strictly for the purposes outlined in this Agreement, with any other use requiring written consent from the Client.
Duration of Confidentiality: Confidentiality obligations persist indefinitely, beyond the termination or expiration of this Agreement.
Client Responsibilities: Clients are responsible for safeguarding the confidentiality of their information shared with Rival.Music® and are encouraged to outline any additional confidentiality needs in writing.
Unlicensed Material and Copyright Infringement
Rival.Music® Studios takes no responsibility for the legality of any intellectual property, samples, or copyrighted material provided or used by the Client during the recording or distribution stages of the Client's project.
The Client assumes full legal and financial responsibility for securing all necessary permissions, licenses, and consents required for the use of such materials.
Any legal actions, claims, or disputes arising from the use of unlicensed or copyrighted material are solely the responsibility of the Client, and Rival.Music® Studios shall not be held liable in any form or manner
Studio Usage and Client Conduct
Use of Facilities
Clients have access to Rival.Music Studios and The Practice Room solely during their booked session times. Any use outside these parameters requires advance written consent from Rival.Music® Studios.
Adherence to Rival.Music Studios’ operational policies, including equipment use and space allocation, is mandatory. Non-compliance may result in session termination without a refund.
Purpose Limitation
Studio bookings must align with the specifically agreed-upon use cases, such as recording sessions. Requests to change the studio's purpose to activities like interviews or video shoots must be approved in writing by Rival.Music® Studios at least 48 hours in advance.
Unauthorised activities without prior approval may lead to session cancellation without refund and could impact future booking eligibility.
Session Etiquette
Respectful and professional behaviour is expected at all times within Rival.Music Studios, The Practice Room, and The Keep’s premises. This includes respect for other clients, adherence to studio guidelines, and avoiding disruptions.
Any breach of etiquette may result in immediate session termination without refund.
Session Overrun Policy
Booked time slots must be strictly observed. Session extensions are subject to availability and require immediate payment for the additional time, pending Rival.Music Studios’ approval.
Overrunning your booked session without approval may lead to its termination without the possibility of a refund.
Prohibited Activities
Illegal or unethical activities, including the use of illicit substances, harassment, or violating copyright laws, are strictly prohibited at Rival.Music® Studios and The Practice Room. Engaging in such behaviour will lead to immediate session termination and may result in legal action.
Venue-Specific Restrictions and Conduct
Clients are required to adhere to specific rules regarding noise levels, accessible areas, and photography or video recording on the premises. Prior approval is needed for any photography or video recording, particularly if involving staff or the facility's interior. Any online sharing of session-related content must be explicitly permitted to ensure privacy is respected.
Sessions may run concurrently within Rival.Music® Studios and The Practice Room, necessitating respectful coexistence among clients. Failure to comply with these guidelines may lead to session cancellation without refund.
Emergency Procedures
Upon arrival, clients will be briefed on emergency procedures, including the locations of fire exits and safety equipment. It's crucial for the safety of all parties that these guidelines are followed as directed by Rival.Music® staff during an emergency.
Exclusivity
Exclusive access to studio facilities and equipment, including the use of both Rival.Music® Studios and The Practice Room, is not automatically guaranteed and requires a prior written agreement. For clients desiring such exclusivity for their projects, detailed arrangements are subject to availability and may involve additional terms and fees.

Surveillance and Security
CCTV Surveillance:
For the safety of our clients and staff, as well as to support our health and safety protocols and meet insurance requirements, CCTV operates 24/7 across all areas of Rival.Music® Studios. This ensures a secure environment and aids in the prevention of unauthorised access or activities.
The Keep, housing Rival.Music Studios and The Practice Room, is equipped with its own security system, enhancing the safety and surveillance of the premises. By accessing our facilities, clients consent to being recorded by these security systems.
Security Protocol and Footage Access:
CCTV footage is handled with strict confidentiality and will only be disclosed if required as evidence of criminal activity or through formal requests by law enforcement agencies.
Clients may request access to CCTV footage pertaining to their session by contacting us at info@rivalmusic.co.uk. Requests will be assessed in accordance with applicable privacy and data protection laws.
Parking Rules
Access and Availability:
Parking at The Keep, which houses Rival.Music® Studios, is available to clients on a first-come, first-serve basis. Despite the ample parking provision, we share this facility with other businesses, and peak times may see increased usage. Clients are advised to allow extra time for parking prior to their sessions.
CCTV Surveillance:
The parking area is monitored by CCTV surveillance for added security. This measure is in place to deter unauthorised access and ensure the safety of vehicles. However, clients park at their own risk, and Rival.Music® Studios, along with The Keep, assumes no liability for loss, damage, or theft of vehicles or their contents while parked on the premises.
Compliance with Parking Regulations:
Clients must comply with all posted parking signs and instructions, including but not limited to, parking within marked spaces. Failure to adhere to these regulations may result in the vehicle being subject to removal at the owner’s expense.
Room Configurations
Rival.Music® Studios has the exclusive right to set up and approve any changes to the layouts in both Rival.Music® Studios and The Practice Room. Clients should not attempt to move furniture or alter the setup themselves.
For any specific setup requests, such as those for podcast recordings that may need additional equipment or furniture changes, clients must get approval from Rival.Music® Studios in advance. Whether these requests can be accommodated will depend on their practicality and how they fit with our space.
All decisions regarding room configurations rest with Rival.Music® Studios.

Instrument Usage Request
For the use of guitars or specific instruments in The Practice Room or Rival.Music® Studios, please inform us in advance to ensure availability.
External/Personal Equipment
Rival.Music® Studios: Clients may bring their own instruments and equipment, such as guitars, brass, string, wind, and percussive instruments, laptops, and accessories. Verify compatibility and safe operation by contacting info@rivalmusic.co.uk prior to your session.
The Practice Room: Clients are encouraged to bring their own instruments, teaching materials, laptops, tablets, and handheld recording devices to aid in teaching or practicing.
Heavy/Large Equipment
Sessions requiring heavy or large equipment, such as drum kits or amplifiers, necessitate a minimum booking of 4 hours. This duration accommodates setup, recording, and packing away. Failure to book the appropriate time for sessions involving such equipment may result in cancellation without a refund.
Equipment and Software Inventory
For a detailed inventory of equipment and software, including VSTs and plugins, please refer to the FAQ section on our website or contact us directly.
Personal Asset Liability
Rival.Music® Studios is not liable for any loss or damage to personal or external equipment brought into the studio. It's recommended that clients secure insurance for their belongings.
Client and Guest Responsibilities
Client Responsibility for Studio Assets and Facilities
Clients must exercise care when using Rival.Music® Studios and The Practice Room assets, including equipment, software, and furnishings, following all provided guidelines and protocols.
Breakages/Damages and Reporting
Clients are liable for any damages they or their guests cause to studio property. Immediate reporting of damages to Rival.Music® Studios is required.
Client Financial Liability for Damages
Clients are financially responsible for repairing or replacing damaged studio property. Rival.Music® will assess damages and inform the client of the costs, which must be settled promptly.
Assessment and Charges
Rival.Music® will provide a detailed estimate for repairs or replacements needed due to client-caused damages. Failure to cover these costs may lead to legal actions to recover the amounts due.
Session Termination
Not reporting damages or failing to meet financial obligations for damages may result in session termination and prohibition from future bookings.
Compliance
Clients must adhere to all applicable laws and studio policies during their sessions.
Energy Conservation
Clients are expected to participate in energy conservation efforts by responsibly using studio resources and powering down equipment when not in use.
Responsibility for Guests
Clients are responsible for their guests' adherence to studio terms and conditions, with Rival.Music® reserving the right to remove any non-compliant guests.
Professional Conduct
All session participants are expected to behave professionally. Clients should limit session attendance to those directly involved in the creative process.
Anti-Harassment/Bullying Policy
Harassment or bullying of any kind is unacceptable and will lead to session termination and possible legal action.
Liability
Rival.Music® disclaims liability for actions or conduct of its personnel and the client's invited third parties. Clients are responsible for the conduct of their third-party hires.
Client's Property
Clients park and store personal property at their own risk. Rival.Music® is not liable for loss or damage to client belongings.
Third-Party Involvement
Inviting additional participants to sessions does not incur extra charges. The hourly rate covers active contributors to the session.
Non-Solicitation Clause
Solicitation or business recruitment activities by clients or their guests within studio premises are prohibited and may result in session termination.
Restricted Access
Client access is limited to hired areas and toilet facilities. No access is allowed to other areas of the facility.
Toilet Use
Toilets are available for client use, with access restricted solely to restroom purposes.
Health and Safety
Clients must follow all health and safety guidelines. Non-compliance can lead to immediate session termination.
Violations and Termination
Rival.Music® may terminate access if clients or their guests violate studio policies, with no refunds for terminated sessions.
Confidentiality
Rival.Music® Studios is committed to maintaining the confidentiality of all client information, project details, and recorded material. Information received from clients is considered confidential and treated with the utmost respect and discretion.
Access and Disclosure
Access to confidential information is strictly limited to authorised personnel within Rival.Music® Studios who require the information to perform their job duties. Any disclosure of client information to third parties outside of these parameters will only occur with the client's explicit consent or as required by law.
Use of Client Data
The information and data provided by clients are solely used for the purpose of delivering the services requested and improving client experiences. This includes session planning, project execution, and communication related to service provision. Rival.Music® Studios will not use client data for unrelated purposes without obtaining prior consent from the client.
Duration of Confidentiality
The obligation to maintain confidentiality of the client's information remains indefinitely, even after the conclusion of the client's sessions or projects with Rival.Music® Studios. This enduring commitment ensures long-term protection of client data.
Client Responsibilities
Clients are responsible for safeguarding their own confidential information and respecting the confidentiality of other clients and projects within Rival.Music® Studios. This includes refraining from disclosing any non-public information about other clients or projects encountered during their time in the studio.
Third-Party Services Policy
Use of Third-Party Services
Rival.Music® incorporates third-party tools and services to enhance the quality of our services. This includes the use of plugins, VSTs, online resources, and Squarespace for website hosting, analytics, and exclusive member services. By utilising our services, the Client acknowledges and consents to the use of these third-party tools within the context of their session.
Acknowledgment of Third-Party Terms
Clients engaging with Rival.Music® services may be subject to third-party terms and conditions. We recommend reviewing these terms to fully understand their practices, as your session may involve tools and services governed by such terms.
No Liability for Third-Party Services
Rival.Music® disclaims any liability for issues arising from the use of third-party services, including but not limited to data disputes or loss. This extends to any mishandling, loss, or misuse of information by third-party services. Clients with specific concerns about third-party tools are encouraged to address these with us prior to their session.
Client Responsibility
It is the Client's responsibility to ensure compliance with any applicable third-party terms when using such services as part of their session at Rival.Music®. This includes understanding the implications of these terms on the use of third-party tools and services employed during their session.
Data Management
Data Retention
Rival.Music® retains personal information only as long as necessary to fulfil the purposes outlined in our Privacy Policy, including service provision, compliance with legal obligations, and dispute resolution. The retention periods vary by the type of information and are determined by our legal requirements and operational needs.
Loss of Data and Breach Response
In the event of any data breach or loss, we commit to promptly notifying affected individuals and undertaking measures to mitigate any potential harm. Rival.Music® has established protocols to address such incidents effectively, ensuring swift action to secure data and prevent future breaches.
Data Security Measures
Our commitment to data security is paramount. We employ various safeguards, including encryption and secure server hosting provided by our website host, Squarespace. For client data transfers, secure platforms like Google Drive, WeTransfer, or Dropbox are recommended, leveraging their encryption and data protection features to ensure the safety of your information.
Client Rights and Data Control
Clients have rights over their personal data in accordance with the UK GDPR, including access, correction, deletion, and restriction of processing. We facilitate the exercise of these rights through direct communication channels, enabling clients to manage their data effectively.
Updates to Data Management Practices
Rival.Music® periodically reviews and updates our data management practices to reflect advancements in data protection and compliance with evolving regulations. Significant changes will be communicated to our clients, reinforcing our commitment to transparency and the protection of personal information.
Acknowledgment of Privacy Policy
By using our services, clients affirm they have read, understood, and agreed to the terms outlined in our Privacy Policy as detailed on the Rival.Music® website. We encourage clients to review the policy regularly to stay informed of how we protect and manage their personal information. Dispute Resolution
Initiating Resolution
Should disagreements or concerns arise, Rival.Music® urges clients to promptly bring these to our attention by contacting us at info@rivalmusic.co.uk, detailing the nature of the issue. Our initial approach is to understand and address any concerns directly, aiming for a resolution that aligns with both the client's satisfaction and our operational policies.
Investigation Process
Each complaint received will be thoroughly investigated by Rival.Music® to gather a comprehensive understanding of the dispute. Our commitment is to resolve issues in a transparent and equitable manner, maintaining open communication with all parties involved.
Proposing Solutions
Based on our investigation, Rival.Music® will propose a solution to the dispute. Our objective is to ensure a fair and reasonable outcome, reflecting the interests of both the client and Rival.Music®.
Mediation as an Alternative
In instances where direct resolution efforts do not yield a mutually agreeable outcome, Rival.Music® is open to mediation involving a neutral third party. This step is intended to facilitate an agreement without resorting to formal legal proceedings.
Legal Recourse
While we view legal action as a measure of last resort, both Rival.Music® and the client retain the option to pursue legal avenues should the dispute remain unresolved through mediation.
Learning and Improvement
Feedback from any dispute is invaluable to Rival.Music® for refining our services and client interactions. We are dedicated to learning from each case to prevent similar issues in the future, continuously improving our practices for the benefit of our clients.
Legal and Financial
Indemnification
The Client shall indemnify, defend, and hold harmless Rival.Music®, its affiliates, officers, agents, employees, and licensors from and against all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney’s fees) arising from the Client’s use of the services or violation of these Terms and Conditions. This includes any third-party claims regarding the Client's content or actions.
No Agency Clause
The relationship established by these Terms and Conditions does not constitute a partnership, joint venture, employment, or agency between the Client and Rival.Music®.
Overall Company Liability
Rival.Music®’s liability for all claims related to the services shall not exceed the amount paid by the Client within the twelve months preceding the claim.
Exclusions of Liability
Rival.Music® disclaims liability for indirect, special, incidental, consequential, or punitive damages, including lost profits, business interruption, or loss of data, beyond the fees paid by the Client.
Limitation of Liability
Liability is strictly limited to direct damages, capped at the total amount the Client has paid for the services, ensuring fairness and responsibility in our operations.

Legal Costs
In legal proceedings, the prevailing party is entitled to reasonable legal costs, promoting a fair resolution process.
Notification and Communication
Clients are required to provide timely notification of any issue that could lead to legal claims, using the specified contact details, ensuring prompt and effective communication.
No Admission of Liability
Actions taken under this Agreement, including dispute resolution and compliance efforts, do not imply fault or liability on the part of Rival.Music®.
Severability
If any part of this Agreement is deemed invalid, the remainder continues in effect, ensuring the continuity and enforceability of our terms.
Intellectual Property Rights
Content created during the use of Rival.Music® services may involve IP rights discussions. Clients retain ownership of their created content; however, they grant Rival.Music® a license to use such content as necessary for service provision, subject to copyright laws discussed earlier.
Updates and Amendments
Rival.Music® reserves the right to update these terms to reflect changes in our services or legal obligations. Clients will be informed of significant amendments to ensure ongoing awareness and agreement.
Termination
Termination of Service
Rival.Music® reserves the right to terminate services or any part thereof, for any user, including the Client, without prior notice, if the user breaches these Terms and Conditions, engages in prohibited conduct, or for any other reason deemed significant by Rival.Music®. Furthermore, services may be terminated by either party for convenience with adequate notice.
Notice of Termination
In cases where termination is initiated by Rival.Music®, we will endeavour to provide the Client with prior notice of termination via email or another reliable method of communication. The Client is similarly required to notify Rival.Music® of their intention to terminate the use of services, ensuring clear and timely communication.
Non-Payment
Services may be suspended or terminated if payment for the services is not received by Rival.Music® within the specified payment period. Rival.Music® reserves the right to discontinue service access due to overdue payments, emphasising the importance of financial compliance.
Effect of Termination
Upon termination, the Client will lose access to the Rival.Music® services, and all information or content stored within the service framework may be deleted. Rival.Music® is not responsible for any loss or damage following termination related to the loss of data.
No Refund
Rival.Music® will not issue refunds for any services terminated due to breach of these Terms and Conditions by the Client. This includes partial refunds for services not fully utilised up to the point of termination.
Legal Action
Rival.Music® retains the right to pursue legal action for breaches that lead to termination, aiming to recover damages, enforce compliance, or address any infringement actions by the Client.
Survival
Certain provisions of these Terms and Conditions will survive termination, including, but not limited to, indemnification, liability limitations, and intellectual property rights. The cessation of services does not nullify ongoing obligations or rights that are meant to persist beyond the service relationship.
